“No. Why didn’t you believe him?”
He had not found an answer.
Captain Avery began the interview.
“Why did you approach Mr. Whitmore?”
“Sergeant Whitmore.”
Avery looked up.
“At the moment you approached him, did you know he was Sergeant Whitmore?”
“No.”
“Then answer the question as it existed at the time. Why did you approach the man in the driveway?”
Castellano shifted.
“He matched the caller’s description.”
“What description?”
“Black male.”
“Anything else?”
“Adult male.”
“Anything identifying?”
“No.”
“Clothing?”
“Not really.”
“Height?”
“No.”
“Age?”
“No.”
“Scars? Tattoos? Hair?”
“No.”
“Specific vehicle?”
“No.”
“Specific house?”
“No.”
Avery folded her hands.
“So the identifying description was essentially race and sex.”
“Yes.”
“What criminal conduct did you observe?”
“None before contact.”
“What additional information did you request from dispatch?”
“None.”
“Why not?”
“I believed I had located the subject.”
“Why?”
Castellano went quiet.
Avery waited.
His union representative glanced toward him.
“Because he was a Black man near a vehicle in the reported area.”
Avery nodded.
That was the first important admission.
Not because matching race alone proved bias.
It did not.
But it established how little information Castellano had before acting.
“What was your legal purpose in requesting identification?”
“I wanted to verify who he was.”
“Did you believe he was detained?”
“No.”
“Could he legally refuse?”
“Yes.”
“Then why did you tell him to cooperate and that you would be done?”
“I was trying to keep the interaction calm.”
Lieutenant Cho spoke for the first time.
“Officer Castellano, listen to the body-camera tone.”
He played the clip.
Just cooperate and we’ll be done here.
Then:
Sir, don’t make this harder than it needs to be.
Cho stopped the video.
“Does that sound like a voluntary request?”
Castellano’s face reddened.
“In hindsight, no.”
“Did you understand in the moment that he might perceive it as an order?”
“I should have.”
“Yes or no.”
“Yes.”
Avery moved to the neighbor.
“Why did Mr. Franklin confirming Whitmore lived there affect your assessment?”
“Because he was a resident.”
“So was Whitmore.”
“I didn’t know that.”
“He told you.”
Castellano rubbed his palms together.
“I had not verified it.”
